Terms and Conditions
1.Object of contract
The scope of the contract is the provision of escorting services for a limited time by one or more persons who are mediated through the agency. The payment is compensation for time spent with the accompanying person. Anything else is not part of this contract.
The actual contract is between the escort and the client. The agency only has a mediation role.
A client can present a booking request by e-mail or phone, this does not lead yet to a contract with Daphne’s. A contract is only concluded when Daphne´s confirm the order via e-mail or phone.
The client is obliged to inform both the agency and the escort about the scope and characteristics of the desired services. The endangerment of the physical integrity or property of the escort must be avoided during the entire length of the booking.
For any tangible and intangible damage to the escort, arising from the dereliction of duty during the execution of the booking, the client is fully liable, unless he was not at fault.
One can cancel the booking without stating a reason. Therefore it suffices to send an email to email@example.com call the agency on 030-99260531.
Cancellation of a date without down payment
If the booked lady does not meet the client’s expectations, this should be communicated to the escort and agency immediately. An allowance of 50 Euro will be charged, which goes in its entirety to the hostess. This is also the case if you cancel whilst she is already on her way.
The right not to pursue a date is also available to the accompanying lady. In this case, the charge will be calculated on a pro-rata basis, meaning based on the actual time spent with the client. If, however, the cancellation is due to your misconduct, the agreed amount is due in full.
Under misconduct, we understand amongst other things: non-compliance with the agreed terms and/or contract, endangering the life or health of your companion, alcohol and substance abuse, poor hygiene, attempted intercourse without protection, false information provided to conclude the date. The escort also reserves the right to proceed with criminal prosecution and/or action for damages.
Cancellation policy if a down payment is required
If you decide to call off the date, the upfront fee will not be reimbursed. Hotel bookings, airline or train tickets that the escort can´t exchange, modify or cancel are also non-reimbursable.
If the escort is unable to attend the appointment, the client will be refunded in full in case of advance payments. Any further claims by the client against the agency are excluded.
You can find our fees on our website. The prices include the 19% VAT.
For bookings in Berlin, there is usually no deposit due. Outside of Berlin, we require a deposit of 30% to 40 % of the agreed fee plus any travel expenses. The deposit must be paid in time by bank transfer.
The client has the possibility to extend the date. In that case, the escort must call the agency. The extension fee is payable before the start of the prolongation in cash.
All costs incurred during the booking shall be borne by the client. These include among others hotel costs, entrance fees, meals and drinks. All escorts granted the Daphne´s GmbH authority for receiving payments.
The remuneration is based on the duration of the date and the actual non-binding price recommendation by the agency. All fees are experience values. The final rate solely resides with the escorts. Since she is self-employed, she is also free in their pricing.
6.Privacy of the escorts
The privacy of the escorts mediated through Daphne’s must be protected. The client shall respect the privacy of the accompanying person and refrain from asking personal contact details. Furthermore, the client commits himself not to contact the booked escort directly and without the knowledge and involvement of the agency.
7. JurisdictionThe choice of forum applies equally to domestic and foreign customers. Place of fulfillment and jurisdiction is exclusively the registered office of Daphne's GmbH.
These terms and conditions are governed by the laws of the Federal Republic of Germany.
